£21,000 lawsuit ruling after track day crash.


I always assumed that there would be a clause in the disclaimer that must be signed before going out on the track that you are relieving the track of all responsibility and that all damage to cars if involved in any incident is the sole responsibility of the owners of the cars and that those taking part are willing to waive there right to sue other parties involved even if the incident occured through no fault of there own.
 
I've been commenting on that, its simply shocking and if the chap loose the appeal which he should go for, then the risks have just increased tenfold. You'll either need fully comp insurance for track (which i dont think is even available) or you'll need deep pockets incase you have an accident with a GT3 :s

You sign a waiver to say your not liable, and in this case the Civic owner should not be liable, but thats all gone to ****.
 
When going on to the track your taking the risk of damage happening to your car full stop. The rules of the road are not exactly being adhered to. I'd be suprised that an insurance company would even entertain a lawsuit of that sort considering it doesn't exactly fall into the social and domestic use part of the insurance bracket. Not to mention the fact that it's on private property and not a public area!
 
That's so bad. When I went to TRAX with my Jordan. I had to sign basically saying **** happens if any damage is caused to your vehicle by yourself or any driver (Appart from TRAX staff) :(

Read the last page, the insurers won the case but after abit of bad publicity have decided not to claim the money back after all. Good for him but not really good for anyone else on track days in the future.

Lol its called "legalise" If its a legally binding contract it will have it in it..

Words can mean something entirely different in law than they do in English.
Thats the beauty of having your own society " The law society " ( To be exact ) it means You can make up your own language ;)

Boring **** really.. my advice don't track race... race on the motorway at midnight ... much safer
 
Track is more safer mate.

not in the case of insurance cover, legal fees, damage to road/fences/building etc will be paid for on the road should you have adequate cover, not the situation on track im afraid
