Bad luck - need advice!

So, after getting a nail stuck in my motorbike (see here: http://www.ek9.org/forum/other-marques/16170-bike-thread.html) tyre last night and having to get it recovered, I let the recovery guy take my bike back to the shop where he said he'd fix it this morning.

So, that was all good, he fixed it as promised and called me when it was ready to pick up. But while waiting to get a lift down to get it, he called to tell me that after he put the bike out at the front of the shop, somebody reversed into it, knocking it over. He took all the drivers details for me since I wasn't present.

Since he's a repair shop, he said he'd put together a quote for repairs (the side of the bike that hit the floor is pretty smashed up). He did say though that the cost may well cause the insurance company to write it off.

So, after all the time I've spent on that bike, the last thing I want is for it to get written off. The damage is esentially cosmetic - its just the cost of parts for my bike is pretty bloody steep.

So I'm left with the following questions, which I hope someone can help me answer:

1. Since this occured whilst the bike was under his care - he chose to move it outside into a parking space where it was at risk - should I handle this any differently from a normal insurance claim?

2. If the insurance company does write it off, how difficult is it to buy it back and get it back on the road?


Pretty heartbroken over this actually - was really beginning to love that bike!!

Any help would be really appreciated.
 
It should not be your problem as it was in his custody and control. That is why he has insurance.
BUT he will probably just tell you to get lost, and then easier just to claim yourself.

one things for certain its not your responsibility.its his and the spa that knocked it over.
 
One thing, if you claim against the car driver, he Denys it and they go knock for knock you will loose your no claims and have an accident on your record even if you dont get it repaired.
