3 Points and a £60 Fine!

Hi EK9'ers,

Got into a little mess with the 'POLICE' yesterday night. Went to cinema, and then went for a little drive across town. I normally don't drive HARD unless if its on the way to work on dual-carriageways or long bendy national speed limit or 50+ roads.

But, i got caught out hard last night. It is a main road en route to the motorway, but i got caught by the speed gun doing 46mph in a 30. Police pulled me over, asked all the questions, if i had insurance, bla dey bla. They gave me a producer, i have to produce my insurance documents, m.o.t and driving license to the police station in the next 7 days (6 days now).

My mate who is a Paraplegic was with me, and i mentioned to the cop i had to go home to pick up his tablets because its urgent. He wasn't listening at all :(

I'm kind of stuck of whether to appeal or pay up and take the points.

Thing is if i take the points and penalty's, my insurance is going to be sky high as renewal is coming up and i am paying a whopping £1700 ish at the moment, and at the moment my financial status ain't too great.

Man it puts me on the spot of thinking of selling up :(

Pay the fine and then appeal.
If they side with you they'll repay you the money.

If you have a look at the ticket it says that if you appeal and still found guilty the points double, fine goes up and I think you have to pay the court fee's - obviously this is to stop every other person appealing!

My friend was extremely lucky, got caught the same as you doing 50+ mph in a 30 zone past a college. Appealed it and when they went to court it was thrown out as the police officer did not turn up! I think this sort of occurence is very rare.

Just out of curiousity did you ask them to show you what the reading on the gun was or any other 'proof' they may of had, I can appreciate your head was all over the place..

take the points and b careful in future :(( if you start appealing then every cop close to u will want to get u for something....its happened me when i got into a bit of bother with them.....they must of started talking and i couldnt go anywhere without being pulled over to make sure everything was right with my car :angry:
 
3 points and a fine wont affect your premium to much as long as u stay with your existing insurance company. when i was 17 i had 3 points and it didnt effect the premium at all, but that was like 10 years ago

1st thing i done was ask the police officer to show me the reading on the gun.

I don't mind paying extra court fees.

I'm normally a careful driver, just was a wrong place wrong time moment.
 
Take the 3 points and fine mate, if you take it to court then its basically the minimum you can get because by not payin the ticket then the judge will take that as an insult because you do not HAVE to accept the ticket you can just be reported.

They don't have to show you the reading on the gun its courtesy,

If it was traffic cops its vey unlikely they will mess up and even with regular cops its unlikely!
 
yeah wrong place at the wrong time, thats just what happened me, like i didnt think i was evan speeding, but there gun said i was, i appealed and said the gun was faulty, didnt evan entertain me, jus had to pay fine, take points and pay court fees, to this day i still dont believe their gun, and i cant go anywere without being stopped by them :angry2:
 
as much as i would say appeal mate it takes a long time to try and get the appeal through and even then after a lot of time wasted you might not even win the appeal!
at the end of the day its worth the shot if u feel you have a strong enough case :)

There's no harm in asking what the speed on the gun is.
 
3 points on a SP30 don't make much difference trust me! Every insurance company i rang said they don't make a lot of difference everyones got one of them! Take the points and the fine and hope they offer the driver awareness course instead of the points. DON'T GO TO COURT! You will come off worse regardless of your reason for speeding! 6 points and up to a £1000 in court!!!

Yeah i get what you mean, but i kind of think i have a valid reason of my mate.

From what i have heard court fees are only going to be Sky high if you have a lame reason.

This is tough :angry2:
 
i would take the point and fine mate, as i got the same when i was 18 with my ek9 and it only went you £50, but when i got 6 points it was like 5000 a year lol.

if you take it to court they will always keep a eye out for you so you would have to be very careful.
 
trust me dont go to court u will lose. I got 11 points and had bans cops hassle me all the time cos it. 3 points wont be much more on insurance mine is £790 a year. I appealed once lose got 5 points instead of 3 and about £250 fine
 
Not being funny. You've broken the law regardless of reason. They have HARD evidence! You won't win. Leave it be is my opinion. No one ever comes out on top in these instances.
 
What??? Double the points when you appeal and lose???? That's insane! They are pretty much taking away your possibility to appeal with that, causing inequality. They have a lot of resources while civilians resources are very limited. I HATE those idiots calling themselves dpt of JUSTICE cause it's no justice if they cause that much inequality!
